ZONING BOARD OF ADJUSTMENT MEETING

May 24, 2004

 

The Chairman, Mr. Peter McNamara, called the meeting to order at approximately 7:30= pm.

Case #2276= – SWEREN, John & Paula/6= 8 Marsh Road – ML 28/7-175 – By John & Paula Sweren.

 

Mr. McNamara said this case had been continued from th= e last meeting to allow the Board to get a response from Town Counsel.  He said he came across a case (Sup= reme Court case Sanderson v. Candia decided in 2001) which was more closely related in facts to the present situation than= the Metzger case cited by the applicant’s counsel in the brief filed with= the Board.  He said the questions = had been raised but didn’t see any new evidence, or any evidence that the Board made a mistake that would compel them to allow a rehearing. 

 

Mr. Gleason had no opposition to declining the request= and had not changed his opinion.  = He said based upon the attorney’s inputs, his opinion remained the same. 

 

Mr. Hennessey said it didn’t appear to be any new evidence and made a motion to turn down the request for a rehearing.
