Chairman Robert Yarmo bro= ught the meeting to order at 7:39 p.m.

HEARINGS:

Map 28; Lot 2-12-4 JRV Homes, = Burns Road = – Dredge & Fill Application

Representing this plan is= Michael Gospodarek, P.E., of Edward Herbert Assoc.= Gove Environmental determined that an application for a minimum impa= ct expedited dredge and fill application was necessary as a precaution relativ= e to a sidewalk installation on the south side of Burns Road. It was Mr. Gospodarek’s understanding that once a subdivision is created that is within 50 yards fr= om a school the developer is required to install sidewalks along the frontage of= the new properties. Mr. Gospodare= k said that within this 50 yards there is an existing culvert and the headwall nee= ds to be constructed along with a guardrail.

MOTION: (Paul Gagnon/Amy Breault) to appro= ve a minimum impact expedited dredge and fill application. VOTE: 4-0 to approve.

Chairman Yarmo will sign = the dredge and fill permit following the meeting.

Map 38; Lot 1-116= Ken Roche/Cormier= & Saurman, 12 Lot Subdivision,

Sherburne Road – Improvements Within Wetland Conservation District

Michael Gospodarek of Edward Herbert Assoc. represents this proposed subdivision. The

Developer is proposing to connect Litchfield Circle Extension to Sherburne Road. An

impact wetlands permit is needed for the buffer zones. The plan is currently before the

Planning Board and they= will be doing a site walk. The roa= dway will be created in the least sensitive area. The impact will be in the buffer z= one area only. Mr. Gagnon and Ms. Scott questioned sheet #7, lots 7 and 6 on the plans and felt that there was an error on the plan. Mr. Gospodarek acknowledged that t= here was an error on the plan. The property has been staked out and flagged and should be easy to access on the site walk and see where the proposed driveway is with relationship to Sherburne Road. A follow-up of this case will be scheduled on next month’s agenda.

OTHER:

Chairman Yarmo referenc= ed to the Conservation Commission’s “Agenda Submittal Policy” t= hat was revised 5/8/00. Curren= tly, the criteria are:&nbs= p; “The Commission meets the second Wednesday of each month at 7:= 30 p.m. Any party requesting pla= cement on the Pelham Conservation Commission Agenda shall submit the following information:

1. = A cover l= etter explaining the proposed project.

2. = One set of full-size plans.

3. = One 11= 221; x 17” full set of plans.

4. = One copy = of drainage/storm water management plan/report, if applicable.

In order to be placed o= n an Agenda, this office must receive all materials no later than the close of business on the Monday before a scheduled meeting. Requests submitted after that day = will be placed on the following meeting agenda.”

Chairman Yarmo and Mr. = Gagnon concurred that there needs to be at least 5 copies of the 11” x 17= 221; plans. Mr. Gagnon asked if th= e same criteria that the Planning Board uses were applied to the Conservation Commission, which are 7 sets of plans required. Mr. Yarmo said that the Planning B= oard operates under different notification policies per statute. Mr. Gagnon is concerned about the = time element that the Conservation Commission gets the plans, i.e., if the pans = are available on the Monday before the meeting of Wednesday, that it doesn̵= 7;t give enough time to review them. Ms. Breault said that if the Commission is going to have a policy, t= here should to be at least a week’s notification in order for it to work.<= span style=3D'mso-spacerun:yes'> We need as many copies of the plan= s that there are permanent members. = The packets are distributed to the members via the postal service and the size = is usually 8 ½” x 11”.&nbs= p; Mr. Gagnon said that the environmental impact plans should be availa= ble at least a week before the meeting.

Ms. Breault asked how strictly would the Commission enforce this policy and suggested that there = be some leeway for at least a couple of months so that submitters would unders= tand the timeline that the Commission has established. All agreed.

The Commission will req= uest that one full-size set of plans be required along with a set of 11 x 17 for each full time member, which currently is six. These plans will be availabl= e to the Commission at least one week prior to the next scheduled meeting. All documents shall be submitted t= hrough the planning office and would then be forward to Conservation members. Chairman Yarmo would like to see a comments section added such as the status with the Planning Board, what act= ion they may have taken, whether it has been referred to the ZBA, etc., and whe= ther there are any environmental impacts and identify any town-owned lands that surround the parcel(s) in question. Mr. Yarmo advised that he would consult with the Planning Director f= or proper language to initiate a comments section.
