Chairman Robert Yarmo bro= ught the meeting to order at 7:40 p.m. at the municipal building. Chairman Yarmo opened the meeting = by welcoming new member Paul Dadak.

Map 25, Lot 12-38 – Poplar Hill Road R= 11; Proposal to purchase parcel to be acquired for Conservation Land

<= /p>

Deb Waters of the Open Sp= ace Committee did a presentation concerning 36 acres of land owned by the Calit= ri family for the sale price of $350,000.00.&= nbsp; An appraisal has been done and came in at $445.000.00. This parcel abuts town-owned land = and borders the Dracut,= MA town line. This parcel has been fully enginee= red and will accommodate 16 house lots if developed. The Calitri family will file for a charitable tax deduction of $95,000 over a three (3) year period. The parcel meets all sub-division regulations and is a forested/wooded parcel. West Environment reports that ther= e are some wetlands but have a high value for wildlife due to the steep slopes an= d is already a wildlife corridor. West Environment also advises that there is no timber value and does not have extensive wetlands. A purchase and sales agreement has= been prepared and the closing date is August 7, 2004. Ms. Waters, in her negotiations wi= th the Calitri family, reported that because the price is $95,000.00 less than what the asking price, the family would like to have this parcel named the ̶= 0;Calitri Family Conservation= Land”. Ms. Waters said that if the Commis= sion approves this parcel that it must be presented to the Board of Selectmen at their meeting on July 13^th in order to meet all deadlines.

PUBLIC INPUT:

Raymond Brunelle of 3 Matthew Drive, Pelham, said that this is a crucial link for wildlife and is a great benefi= t to the town.

BACK TO THE BOARD:

All members were in agree= ment with the benefits of the parcel and agreed on the sale price, that it meets= all criteria of the Commission and that the funds be used from the Bond Fund.

MOTION: (Amy Breault/Shirley Wakefield) to purchase the 36 acres for $350,000.00, funds from the Bond Fund, and that t= he parcel to be named The Calitri Family Conservation Land.

VOTE: 6-0 in the affirmative (Shirley Wakefield, Deborah Scott, Paul Gagnon, Amy Breault, Paul Dadak and Robert Yarmo).

Map 38, Lot 1-116, Litchfield Circle – Schedule Site Walk

A site walk for this land= will be conducted on Wednesday, July 7 at 6 p.m.&n= bsp; Members will meet in the parking lot of the municipal building.

Map 26, Lot 2-79 – Hinds Lane<= /st1:Street> – Proposal to purchase parcel to be acquired for use as conservation = land.

The hearing on this parce= l is rescheduled for Wednesday, July 14, 2004 at the municipal building. Ms. Waters will submit all appropr= iate legal notices to the newspapers. Three notices will also be posted in town (municipal bldg., library, post office)

OTHER:

Map 9, Lot 145, Pel= ham Fish & Game Club, 100 Simpson Mill Road, Wetlands Violation

Chairman Yarmo updated the members that DES had accepted the Conservation Commission’s appeal to= a dredge and fill permit that had been issued. Additional wetland violations were= noted, upward to 70,000 sq. ft.

Paul Gagnon questioned if= the Conservation Commission should respond to the Pelham Fish and Game Club ema= il to the selectmen as it contained untrue statements and was derogatory to the Conservation Commission.

A brief discussion regard= ing the email occurred. Chairman Yarmo polled the members whether to respond or not. All members felt a response was re= quired to correct the record.

NEW BUSINESS:

Chairman Yarmo said that = the by-laws of the Commission needed to be reviewed and changes be made where appropriate.

The next meeting of the Commission is Wednesday, July 14, 2004, 7:30 p.m.
