Chairman Yarmo brought the meeting to order at 7:38

HEARINGS:

Map 29, Lot 7-41 –= ; David Bibeau, dba: Oscars Removal, 36 Atwood Road, Site Plan Application to const= ruct a 30 x 40 garage within the Wetland Conservation District adjacent To a Pri= me Wetland

Present was David Bibeau = and Mark Jennings of Edward Herbert Associates.&nbs= p; Chairman Yarmo asked Mr. Jennings to give a history on this case. Mr. Jennings explained that previo= us plans had been submitted that showed a garage to be constructed behind the existing house that was in the WCD. A dredge and fill permit had been approved by the state, that the Conservation Commission asked to intervene in this decision and when the ca= se came before the Planning Board the permit was denied because it was too clo= se to the wetlands. A second var= iance was granted based on the plan presented this evening.

Being presented tonight i= s a revised variance that now shows the 30 by 40 ft garage at a new location, m= ore to the front and right of the property.&nb= sp; The plan shows an earthen berm around the building and is one foot a= bove the wetlands. Mr. Bibeau said= that he plans to reestablish the buffer by planting white pines every 20 feet. Mr. Yarmo asks that the natural ve= getation be allowed to grow back to its natural state.

MOTION: (Amy Breault/Paul Gagnon) To recom= mend that the buffer zone be restored to its natural state with vegetative matter and that the shed be removed from the back of the property out of the buffe= r zone. VOTE: 4-0 to support this motion.

Meeting Minutes Approved = for 7/14/04 (Motion by Amy Breault, seconded by Bob Yarmo) VOTE: 3, 1 abstain (Paul Gagnon)

The Commission moved to a Non-Public session regarding a purchase and sales agreement.
