sold repairable collisions (that had been purchased at auctions) in a space
consisting of approximately 2500SF.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Guilbault had been in business (at that location) since 1994 /19=
95
and thought he was operating legally, but was notified that he needed a
variance.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Typically the vehic=
les
purchased at the auctions could be driven, but were not road worthy, and
therefore towed to the site.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Vehicles are seen by appointment only and when purchased are towed
away.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The variance was needed
because the business was considered a used car dealership located in the
Industrial Zone.<span style=3D'mso-spacerun:yes'>&nbsp; </span>To the
applicant&#8217;s knowledge, there had been no complaints about the
business.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Attorney Shepherd reviewe=
d the
Variance criteria (as submitted) as follows: </p>

permitted in this zone.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The
Applicant is not able to find property comparable to his present location,
within the Business Zone. </i></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoBodyTextIndent style=3D'text-align:justify'><span style=3D'fo=
nt-size:
10.0pt'>ii. no fair and substantial relationship exists between the general
purposes of the zoning ordinance <o:p></o:p></span></p>

<p class=3DMsoBodyTextIndent style=3D'margin-left:45.0pt;text-align:justify=
'><span
style=3D'font-size:10.0pt'>and the specific restriction on the property bec=
ause: <i
style=3D'mso-bidi-font-style:normal'>The Industrial Zone is an appropriate
location for the Applicant&#8217;s business.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Damaged vehicles purchased by the
Applicant are brought to the business by a ramp truck or tow truck.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Vehicles that are purchased are re=
moved
from the business location by the same method.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>This is consistent with other acti=
vities
in the Industrial Zone and in the adjacent industrial park. <o:p></o:p></i>=
</span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoBodyTextIndent style=3D'text-align:justify'><span style=3D'fo=
nt-size:
10.0pt'>iii. the variance would not injure the public or private rights of
others since: <i style=3D'mso-bidi-font-style:normal'>The Applicant&#8217;s=
 <o:p></o:p></i></span></p>

<p class=3DMsoBodyTextIndent style=3D'margin-left:48.0pt;text-align:justify=

ess has

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>3. The Variance is consis=
tent
with the spirit of the ordinance because: <i style=3D'mso-bidi-font-style:n=
ormal'>Much
more intensive uses are allowed in the Industrial Zone.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The Applicant&#8217;s business is
unique.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The Applicant purchas=
es
vehicles at an auction and stores or warehouses them at the property.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The vehicles are not operated on t=
he
site.<span style=3D'mso-spacerun:yes'>&nbsp; </span>No repairs occur on
site.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Warehousing is a permit=
ted
use in the Industrial Zone.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Customers are allowed to view the vehicles by appointment only. <o:p=
></o:p></i></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>4. Substantial justice is=
 done
because: <i style=3D'mso-bidi-font-style:normal'>Although this particular u=
se is
not permitted, similar uses, such as warehousing and the selling of new boa=
ts,
trailers and aircraft are permitted.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>The proposed use by the Applicant is reasonable and consistent with
other uses within the Industrial Zone. <o:p></o:p></i></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>5. The value of the surro=
unding
properties will not be diminished because: <i style=3D'mso-bidi-font-style:=
normal'>The
Applicant&#8217;s business is small in scope and volume.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>No more than fifteen (15) vehicles=
 will
be stored on the property at any given time.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The vehicles are neatly stored on =
site,
behind a large fence that shields the vehicles from being seen from <st1:St=
reet
w:st=3D"on"><st1:address w:st=3D"on">Mammoth Road</st1:address></st1:Street=

style=3D'mso-spacerun:yes'>&nbsp; </span>The business has been in place for
approximately ten (10) years, with no impact on surrounding property.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The Applicant&#8217;s business is =
neat
and clean. <o:p></o:p></i></p>

<p class=3DMsoNormal style=3D'text-align:justify'><b style=3D'mso-bidi-font=
-weight:
normal'><u><o:p><span style=3D'text-decoration:none'>&nbsp;</span></o:p></u=
></b></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Attorney Shepherd said the
applicant understood that if a variance was granted, he would have to go be=
fore
the Planning Board to seek Site Plan approval. </p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>There was a brief discuss=
ion
regarding the existing fence along <st1:Street w:st=3D"on"><st1:address w:s=
t=3D"on">Mammoth
  Road</st1:address></st1:Street>.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Guilbault said he could install a 15-foot fence along the left s=
ide
of the parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. O&#8217;Sullivan aske=
d what
surface the vehicles were parked on.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Guilbault said the vehicles were parked on crushed stone.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said the cars were rotated fair=
ly
quickly; normally approximately one hundred cars per year were sold.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. O&#8217;Sullivan said the Town=
 had a
significant problem with water quality (contamination) issues and was conce=
rned
with adding to that potential.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Attorney Shepherd said they were also concerned and felt it would be
handled during the Planning Board&#8217;s review.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey said the mechanism by
which the Town had reassured that some of the fiascos from that past didn&#=
8217;t
happen again was by having a consent decree signed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said he would like a consent de=

entered into (with periodic soil tests).<span style=3D'mso-spacerun:yes'>&n=

would also have to review.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr.
Gowan said if the application was successful before the Planning Board under
Site Plan review it would have to go before the Selectmen for (by the
Town&#8217;s Regulations) a vehicle junkyard license.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said he had been to the site and
believed it was a reasonable use of the property where it was located.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Ms. Paliy asked if there =
was a
requirement for there to be a barrier to the soil where the cars were

unsure, but believed it would be reviewed by the Planning Board.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>It was noted that the cars were
currently on crushed stone that was able to be plowed in the winter.<span

and said it was hard to argue (given the recent court cases) that the appli=

shouldn&#8217;t be allowed to continue the usage and there was detriment to=
 the
community (as long as there were proper safeguards regarding pollution and
water resources).<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McNamara
added that the variance was specific to the business the applicant was cond=
ucting.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He wanted it made clear that it wa=
s the
only variance being granted; it was not a general use, or subsequent expans=
ion
of use.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said the Planning =
Board

existing deck to be razed and asked if there would be another deck.<span

Maynard said it was a one-story (with vaulted ceiling) (approximately 26-fe=
