Vice Chairman Paul Gagnon= brought the meeting to order at 7:31 p.m.

NEW BUSINESS: Reappointment of Land Stewardsh= ip Chairman

Deborah Waters, 6 Harley = Road, Pelham is the current chairman and came before the Commission to be reappoi= nted as chairperson of the Land Stewardship Committee. Deborah explained that she had been appointed by the Commission in November of 2004 to head up a sub-committee.= She explained that one of her duti= es was to try to attract volunteers who could help in caring for the properties th= at the Conservation Commission manages. At the first meeting two people showed up she said. Quite a bit of work was accomplish= ed in 2005 and now the committee is starting their 2006 season. She now has approximately 25 perso= ns working on this who have pledged to help out. She also said that she has a list = of persons who have contacted her and stated that they would help her as well.= Deborah said as of right now there= are 8 properties that the Conservation Commission has and are required to manage. She said that she had= gone back into the records to review the commitment of the Conservation Commissi= on and the parcels are as follows: 1985- 16 acres by the Dunlap family; 2001 - 1 acre on Debbie Drive; = 2002 - 23 acres, Wolven Park on Jericho Road; Little Island Pond Conservation la= nd, Nature’s Way; Calitri, Poplar Hill Road; 150 acres on Hinds Lane; Cos= ta property on Dutton Road; 110 acres on Sherburne Road known as the Merriam property.

Deborah cited Statute, 36= -A in part, which requires the Conservation Commission, if they acquire land in t= heir name, “Shall manage and control the land……..and that is w= hy we need help from volunteers from the community”. She also briefly cited Section 2 o= f that same RSA where is says “Allows a Commission to appoint such clerks and other employees and or sub committees as it may need from time to time……….”. Deborah said she had spoken to Margery Swope of the NH Association of Conservation Commissions who advised that local Commissions have a mirade of choices in choosing land stewards and one might be an associate member. Deborah said because she’s b= een the Land Steward Chairperson she’s asking to be reappointed.

Member Jay Stearns asked = Deborah to give the Commission a brief overview of what has transpired by this sub-committee in the last 6 months. Member Glennie Edwards asked Deborah if she would accept a 3-year appointment? Deborah answered= in the affirmative and said this would give some consistency to this appointment. Deborah also sug= gested that this 3-year appointment might be in order for Bill McDevitt who is the co-chairman. Vice Chairman Ga= gnon said as of last night’s voting (March 14), the town now has 9 parcels= , the most recent one being at the end of Stonepost Road where 2222 voters suppor= ted the adoption of this town-owned parcel to be designated as Conservation land/town forest. Deborah ann= ounced that volunteers of this sub-committee would be active in cleaning up the Hinds Lane = property on Earth Day, April 22. Vice Chairman Gagnon asked Deborah to keep the selectmen informed of the on-going activities by way of Tom Gaydos. Deborah said that she keeps minutes of any ‘formal’ meet= ings that she has. Member Mrs. Edw= ards asked for a duplicate copy of Deborah’s minutes and that they would be placed in file in the Conservation’s records. Deborah agreed.

Vice Chairman Gagnon anno= unced that the entire perimeter of Hinds Lane has been blazed as of last Thursday. This happened with the help of Deborah’s husband Steve, Dan Cyr the town forester and his assistant Brian Johnson as well as himself. He said it took the entire day.

MOTION: To appoint Deborah Waters to a 3-y= ear term as chairperson on the Land Stewardship Committee (Edwards/Dadak)

VOTE: 5-0 to endorse this appointment.

Map 35; Lot 6-113 KLN Construction, 79 Bridge St= reet, Minimum Impact Dredge & Fill Permit.

Mike Gospoderek, engineer= with Ed Herbert Associates represented this case.&= nbsp; The minimum impact is 430-sq.ft. which is located immediately south = of Old Bridge Street South<= /st1:Street>. Owner/developer is Don Nickles. His intention is to build a 4-bedr= oom house. Plan showed the septic design, house location and proposed driveway = with headwalls. There is a 20̵= 7; drop off from the main road, route 38.&nbs= p; Mr. Gospoderek asked to amend the wetland impact from 300-sq.ft. to 430-sq.ft. Proposed is a guar= drail and a 24” corrugated pipe under the driveway. Vice Chairman Gagnon asked if the = house could be pushed back further or go further uphill towards the north, toward= the septic system, as it appeared the house was being “wedged in with a shoehorn”. Mr. Gospoder= ek answered no that they were at the minimum setback to the septic system. The parcel is 1.4 acres. Mr. Gagnon questioned the parking = area in front of the garage and said it is in the WCD. Mr. Gospoderek said that was so ve= hicles could turn around and head out onto route 38.

Member Jay Stearns questi= oned whether a wetland has to be duplicated when it has been taken. Mr. Gospoderek said that would only apply in larger areas such as when the impact was over 10,000 sq.ft. Mr. Stearns also questioned the fl= ow going through the 24” culvert. Mr. Gospoderek said that it was a seasonal type brook and that the s= tate had made their recommendations due to Blanding turtles that were found in t= his area. Mr. Gagnon asked if dur= ing the construction would there be any disruption of the WCD other than what is outlined on the plan. Mr. Gos= poderek answered yes, that he had colored the area in red, that there would be eros= ion control with a siltation fence. There is about 7,700 sq. ft. of disruption said Mr. Gospoderek. Mr. Gagnon said that a letter woul= d be going to the Planning Board and would state that the wings on the head wall= be brought out at a 45 degree angle to minimize the WCD impact and that signag= e be erected on both sides of the wetland. Mr. Stearns asked about the use of rectangular culverts that allow f= or larger animals to use. Mr. Gospoderek said that that type of culvert is used where there is a vernal p= ool involved. He said that there = is a contradiction to what Mark West had said about the use of these because Jim Gove who sits on the state’s wetland board has made presentations at Planning Board meetings that these culverts that are made for creature cros= sing don’t really work and that there is more and more evidence coming out every year that they don’t work.&nbs= p; Member Lisa Loosigian asked if a site walk was in order. Mr. Gospoderek was concerned that = if we put off our vote that we meet after the Planning Board session and this wil= l be delayed for two sessions. Vice Chairman Gagnon suggested that we could work this off line, to do a site wa= lk if we wished, that it would serve as a learning experience. He said that this was a terrible s= ite but it was not our call and that it met the town’s regulations. Also, that it was a Planning Board’s responsibility of whether this site is build able because of = the severe drop off from route 38. Vice Chairman Gagnon will confer with the Planning Director to see if the WCD language proposed in the motion be recorded in the deed.

MOTION: (Dadak/Edwards) to sign a dredge a= nd fill application, as amended, to read 430-sq.ft. of minimum impact. VOTE: 5-0 to approve.

MOTION: ( = /Edwards) to send a letter to the Planning Board recommending that t= he developer be required to install signage along the WCD and that the headwal= ls be deflected further from the wetlands, something less than 90 degrees, to minimize wetland impact and to ask if there should be language inserted into the homeowner’s deed.

VOTE: 5-0 to send a letter to the Planni= ng Board with the above noted stipulations.

Map 17, Lot 12-253, Co= ncordia Homes, Kennedy Drive – Minimum Impact Expedited Dredge & Fill Per= mit

Mike Gospoderek, engineer= for Ed Herbert Associates represents this case. Tom Piekarski, dba Concordia Homes is the owner of record. This is a 573-sq.ft. impact on a seasonal stream for a driveway crossing. This is a 4-lot sub-division conta= ining approximately 8 acres. Mr. Gospoderek showed pictures that were taken in February (06) that showed a tree-type forested wetland. V= ice chairman Gagnon asked how the erosion control was going to be handled, referring to the 10% grade of the road.&nb= sp; Mr. Gospoderek said they would be using a lot of the filter fabric blankets on the slopes. Mulch= berm is also used he said. Mr. Gospoderek said they will be working with the Planning Board’s consul= tant of how to handle the water that comes out of Kennedy Drive and the water that go= es across the wetland and provide a street drain, known as a storm scepter at = the end of the street. It takes t= he point source and goes into a specially designed 8-ft or 10-ft diameter structure in the case of a storm event he said. It creates an interesting swirling action said Mr. Gospoderek. It takes the debris and sends it one way and takes all the grease and particles and sends it another way and what comes out is 98% treated. It’s an alternative to treat= ment swales. He said storm scepter= s are very easily cleaned by the use of a vacuum truck. Mr. Gagnon said that in this case,= even though the wetland impact is slightly larger than the KLN Construction, he didn’t see the large WCD impact.

Vice Chairman Gagnon said= there is an existing house with an existing shed “right smack in the WCD”; can there be a little compensation to have the shed moved out of the WCD? Mr. Gagnon didn̵= 7;t know if it was grand fathered or whether we can require moving it or not. Mr. Gospoderek said he could make = that recommendation to the Planning Board and advise the homeowner that we are asking to have it relocated. = This house has a big back yard and there shouldn’t be a problem as to wher= e it can be moved said Mr. Gagnon. There is also an existing trail on this parcel (page 3, lower left on the plan).<= span style=3D'mso-spacerun:yes'> Mr. Gagnon asked if there was any = effort to maintain this trail or bridges? Mr. Piekarski, dba Concordia Homes joined Mr. Gospoderek at the tabl= e. He currently owns the property; he purchased it a couple of weeks ago. When this gets approved he is selling the house and the shed back to= the original owner, so he won’t own the land he says. He has spoken with Mr. Gowan of the planning office about the plan. He suggested that the house on lot #3 be moved up 20 to 30 feet, which he beli= eves he can, and then he would be fine with the trail. Mr. Piekarski said the information= would be on the deed about the trail. Mr. Gagnon said he appreciated that the house could be moved, but it would be easier if the trail were moved to the back end of the property. Mr. Piekarski said in talking with= Mr. Gowan about the trail the liability was the issue. Mr. Gagnon said the state of NH ha= s a million dollar liability policy. Mr. Gagnon said he believed that the local “Border Riders Snowmobile Club” has their own policy for a million dollars as well. Member Jay Stearns aske= d if the homeowner wished, could they forbid traveling on that section of trail? He was comparing this = issue with a section at the end of Stonepost Road where a homeowner had a problem and the t= rail got moved off his property. M= r. Piekarski said the previous owner, Mr. Campbell, had no idea that there was= a trail there. According to Mr. Piekarski Mr. Campbell, who has been there since 1973, didn’t know th= ere was a trail there and would never have allowed anyone onto or over the property. The plan shows an existing bridge on the property that Mr. Campbell was not aware of either s= aid Mr. Piekarski.

Mr. Gagnon said there are= a couple of issues: To protect = the existing trail and to move the shed out of the WCD, post WCD signage. These recommendations will be forw= arded to the Planning Director by way of a letter.

MOTION: (Stearns/Edwards) to approve the d= redge and fill application and to forward our recommendations, as stated in the p= revious paragraph, to the Planning Board.

VOTE: 5-0 to approve application and make recommendations to the Planning Board.

Open discussion on how Commission should proceed on applying for grants.

Vice Chairman Gagnon said= that he has many opportunities for grants that come to him via emails and never get processed. One that he had re= ceived recently from Bill McDevitt was from the National Fish & Wildlife Foundation and Walmart (these are combined). Others mentioned were DES Water Su= pply Division, Boston Foundation’s TBF grant and Home Depot. Member Jay Stearns offered to take= one of these and come back to the Commission with information on what it is and what’s required, deadlines, etc.&nbs= p; He said he would prepare an outline to see if it is something we wan= t to pursue. Member Paul Dadak off= ered to research some of the sites also.

Mr. Gospoderek said that = about 8 years ago the town of Hudson hired a grant writer and shared the grant writer with other various abutting communities to go after grants. He said there might be other communities that hire professional grants writers that we could share the costs with. He also said that there might even be a way that you can pull a port= ion of that cost out of the grant monies. Nashua Regional Planning Commission may have some information as they were involved in it he said. =

OTHER:

Mrs. Edwards asked if the Commission was looking for members to join the Commission as two current members are up for re-appointment and we’re not sure of their intenti= ons.

MINUTES: Not everyone had read over the min= utes of 2/15/06 and therefore they were not approved. Glennie will send them out again.<= span style=3D'mso-spacerun:yes'> She asks for any corrections or ch= anges so that she can forward the approved minutes to the Planning office.
