ip
Chairman</b></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Deborah Waters, 6 Harley =
Road,
Pelham is the current chairman and came before the Commission to be reappoi=
nted
as chairperson of the Land Stewardship Committee.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah explained that she had been
appointed by the Commission in November of 2004 to head up a sub-committee.=
<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She explained that one of her duti=
es was
to try to attract volunteers who could help in caring for the properties th=
at
the Conservation Commission manages.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>At the first meeting two people showed up she said.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Quite a bit of work was accomplish=
ed in
2005 and now the committee is starting their 2006 season.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She now has approximately 25 perso=
ns
working on this who have pledged to help out.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She also said that she has a list =
of
persons who have contacted her and stated that they would help her as well.=
<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah said as of right now there=
 are 8
properties that the Conservation Commission has and are required to
manage.<span style=3D'mso-spacerun:yes'>&nbsp; </span>She said that she had=
 gone
back into the records to review the commitment of the Conservation Commissi=
on
and the parcels are as follows:<span style=3D'mso-spacerun:yes'>&nbsp;
</span>1985- 16 acres by the Dunlap family; 2001 - 1 acre on Debbie Drive; =
2002
- 23 acres, Wolven Park on Jericho Road; Little Island Pond Conservation la=
nd,
Nature&#8217;s Way; Calitri, Poplar Hill Road; 150 acres on Hinds Lane; Cos=
ta
property on Dutton Road; 110 acres on Sherburne Road known as the Merriam
property.</p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Deborah cited Statute, 36=
-A in
part, which requires the Conservation Commission, if they acquire land in t=
heir
name, &#8220;Shall manage and control the land&#8230;&#8230;..and that is w=
hy
we need help from volunteers from the community&#8221;.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She also briefly cited Section 2 o=
f that
same RSA where is says &#8220;Allows a Commission to appoint such clerks and
other employees and or sub committees as it may need from time to
time&#8230;&#8230;&#8230;.&#8221;.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Deborah said she had spoken to Margery Swope of the NH Association of
Conservation Commissions who advised that local Commissions have a mirade of
choices in choosing land stewards and one might be an associate member.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah said because she&#8217;s b=
een
the Land Steward Chairperson she&#8217;s asking to be reappointed. </p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Member Jay Stearns asked =
Deborah
to give the Commission a brief overview of what has transpired by this
sub-committee in the last 6 months.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Member Glennie Edwards asked Deborah if she would accept a 3-year
appointment?<span style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah answered=
 in
the affirmative and said this would give some consistency to this
appointment.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah also sug=
gested
that this 3-year appointment might be in order for Bill McDevitt who is the
co-chairman.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Vice Chairman Ga=
gnon
said as of last night&#8217;s voting (March 14), the town now has 9 parcels=
, the
most recent one being at the end of Stonepost Road where 2222 voters suppor=
ted
the adoption of this town-owned parcel to be designated as Conservation
land/town forest.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah ann=
ounced
that volunteers of this sub-committee would be active in cleaning up the <s=
t1:Street
w:st=3D"on"><st1:address w:st=3D"on">Hinds Lane</st1:address></st1:Street> =
property
on Earth Day, April 22.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Vice
Chairman Gagnon asked Deborah to keep the selectmen informed of the on-going
activities by way of Tom Gaydos.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Deborah said that she keeps minutes of any &#8216;formal&#8217; meet=
ings
that she has.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Member Mrs. Edw=
ards
asked for a duplicate copy of Deborah&#8217;s minutes and that they would be
placed in file in the Conservation&#8217;s records.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Deborah agreed.</p>

that the entire perimeter of <st1:Street w:st=3D"on"><st1:address w:st=3D"o=

  Lane</st1:address></st1:Street> has been blazed as of last Thursday.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>This happened with the help of
Deborah&#8217;s husband Steve, Dan Cyr the town forester and his assistant
Brian Johnson as well as himself.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He said it took the entire day.</p>

</span>The minimum impact is 430-sq.ft. which is located immediately south =
of <st1:Street
w:st=3D"on"><st1:address w:st=3D"on">Old Bridge Street South</st1:address><=
/st1:Street>.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Owner/developer is Don Nickles.<sp=
an
style=3D'mso-spacerun:yes'>&nbsp; </span>His intention is to build a 4-bedr=
oom
house. Plan showed the septic design, house location and proposed driveway =
with
headwalls.<span style=3D'mso-spacerun:yes'>&nbsp; </span>There is a 20&#821=
7;
drop off from the main road, route 38.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>Mr. Gospoderek asked to amend the wetland impact from 300-sq.ft. to
430-sq.ft.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Proposed is a guar=
drail
and a 24&#8221; corrugated pipe under the driveway.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Vice Chairman Gagnon asked if the =
house
could be pushed back further or go further uphill towards the north, toward=
 the
septic system, as it appeared the house was being &#8220;wedged in with a
shoehorn&#8221;.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gospoder=
ek
answered no that they were at the minimum setback to the septic system.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The parcel is 1.4 acres.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon questioned the parking =
area
in front of the garage and said it is in the WCD.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gospoderek said that was so ve=
hicles
could turn around and head out onto route 38.</p>

whether a wetland has to be duplicated when it has been taken.<span

apply in larger areas such as when the impact was over 10,000 sq.ft.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Stearns also questioned the fl=
ow
going through the 24&#8221; culvert.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Gospoderek said that it was a seasonal type brook and that the s=
tate
had made their recommendations due to Blanding turtles that were found in t=
his
area.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon asked if dur=
ing
the construction would there be any disruption of the WCD other than what is
outlined on the plan.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gos=
poderek
answered yes, that he had colored the area in red, that there would be eros=
ion
control with a siltation fence.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>There is about 7,700 sq. ft. of disruption said Mr. Gospoderek.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon said that a letter woul=
d be
going to the Planning Board and would state that the wings on the head wall=
 be
brought out at a 45 degree angle to minimize the WCD impact and that signag=
e be

573-sq.ft. impact on a seasonal stream for a driveway crossing.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>This is a 4-lot sub-division conta=
ining
approximately 8 acres.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr.
Gospoderek showed pictures that were taken in February (06) that showed a
tree-type forested wetland.<span style=3D'mso-spacerun:yes'>&nbsp; </span>V=
ice
chairman Gagnon asked how the erosion control was going to be handled,
referring to the 10% grade of the road.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>Mr. Gospoderek said they would be using a lot of the filter fabric
blankets on the slopes.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mulch=
 berm
is also used he said.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr.
Gospoderek said they will be working with the Planning Board&#8217;s consul=
tant
of how to handle the water that comes out of <st1:Street w:st=3D"on"><st1:a=
ddress
 w:st=3D"on">Kennedy Drive</st1:address></st1:Street> and the water that go=
es
across the wetland and provide a street drain, known as a storm scepter at =
the
end of the street.<span style=3D'mso-spacerun:yes'>&nbsp; </span>It takes t=
he
point source and goes into a specially designed 8-ft or 10-ft diameter
structure in the case of a storm event he said.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>It creates an interesting swirling
action said Mr. Gospoderek.<span style=3D'mso-spacerun:yes'>&nbsp; </span>It
takes the debris and sends it one way and takes all the grease and particles
and sends it another way and what comes out is 98% treated.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>It&#8217;s an alternative to treat=
ment
swales.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said storm scepter=
s are
very easily cleaned by the use of a vacuum truck.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon said that in this case,=
 even
though the wetland impact is slightly larger than the KLN Construction, he
didn&#8217;t see the large WCD impact. </p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Vice Chairman Gagnon said=
 there
is an existing house with an existing shed &#8220;right smack in the
WCD&#8221;; can there be a little compensation to have the shed moved out of
the WCD?<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon didn&#821=
7;t
know if it was grand fathered or whether we can require moving it or not.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gospoderek said he could make =
that
recommendation to the Planning Board and advise the homeowner that we are

house has a big back yard and there shouldn&#8217;t be a problem as to wher=

effort

</span>Mr. Piekarski, dba Concordia Homes joined Mr. Gospoderek at the tabl=
e.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He currently owns the property; he
purchased it a couple of weeks ago.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>When this gets approved he is selling the house and the shed back to=
 the
original owner, so he won&#8217;t own the land he says.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He has spoken with Mr. Gowan of the
planning office about the plan.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>He
suggested that the house on lot #3 be moved up 20 to 30 feet, which he beli=
eves
he can, and then he would be fine with the trail.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Piekarski said the information=
 would
be on the deed about the trail.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>Mr.
Gagnon said he appreciated that the house could be moved, but it would be
easier if the trail were moved to the back end of the property.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Piekarski said in talking with=
 Mr.
Gowan about the trail the liability was the issue.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gagnon said the state of NH ha=
s a
million dollar liability policy.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Gagnon said he believed that the local &#8220;<i>Border Riders
Snowmobile Club</i>&#8221; has their own policy for a million dollars as
well.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Member Jay Stearns aske=
d if
the homeowner wished, could they forbid traveling on that section of
trail?<span style=3D'mso-spacerun:yes'>&nbsp; </span>He was comparing this =
issue
with a section at the end of <st1:Street w:st=3D"on"><st1:address w:st=3D"o=
n">Stonepost
  Road</st1:address></st1:Street> where a homeowner had a problem and the t=
rail
got moved off his property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>M=
r.
Piekarski said the previous owner, Mr. Campbell, had no idea that there was=
 a
trail there.<span style=3D'mso-spacerun:yes'>&nbsp; </span>According to Mr.
Piekarski Mr. Campbell, who has been there since 1973, didn&#8217;t know th=
ere
was a trail there and would never have allowed anyone onto or over the
property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The plan shows an
existing bridge on the property that Mr. Campbell was not aware of either s=
aid
Mr. Piekarski.</p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Gagnon said there are=
 a
