PLANNING BOARD MEETING

PUBLIC HEARING ON PROPOSED ZONING AMENDMENTS

Item #1: Amend Article II Definitions, Section 307-6 to properly explain what im= pact fees are and how they are created, the Planning Board proposes to add an im= pact fee definition describing how the Town enacts impact fees and referencing R= SA 674:21 V.

Item #2: Amend Article V Permitted Uses, Section 307-18, Table 2 to provide oversight of new power producing technologies which are becoming more affordable for private purchase, the Planning Board proposes the following:

Private Utility Structures; i= .e. windmills, watermills, free-standing solar collectors, etc. Permitted** in R, B, I, Ru, RCA=

** Permitted with Planning Bo= ard Site Plan approval, all applicable safety inspections as deemed appropriate= by the Planning Board and proper licensing by applicable state and federal agencies.

Item #3: Amend Article IX Senior and Elderly Housing, Section 307-53 A and 307-53-4 D to correct a conflict that currently directs an applicant to provide plans based on two separate sets = of regulations, the Planning Board proposes to remove references to Site Plan Regulations throughout all of Article IX.

Item #4: Amend Article XI Signs, Section 307-68 and 307-69 I to make the sign pe= rmit application process more effective, the Planning Board proposes to add lang= uage requiring more information and a color rendering for each proposed sign. Additionally, to make it more clear who approves sign permits, the Planning Board proposes that the definition of “building official” be changed under Article XI 307-69, to make the building official whomever is appointed by the Board of Selectmen to administer sign permits.

Item #5: Amend Article XII Special Exceptions, Section 307-76 II Minor Home Occupations to allow a small sign for legal home occupations and to provide= for a uniform standard so signs are appropriate for residential neighborhoods, = the Planning Board proposes new language be added. The added language would per= mit one sign not to exceed 1.5 sq. feet in size and that cannot be directly illuminated. A second sign of the same size would be permitted if a second = home occupation that also meets all the requirements of 307-76 II exists within = the same residence. No more than two signs would be allowed and both would requ= ire permits.

Item #6: Replace in its entirety t= he Impact Fee Ordinance proposed by the Planning Board and adopted by Pelham voters in March of 1999 that enables the Planning Board and Selectmen to establish impact fees to help reduce the tax burden and help pay for Town a= nd School capital projects that are needed as a result of residential developm= ent. The revised impact fee ordinance reflects recent changes in the law. The on= ly substantive differences between the existing Impact Fee ordinance and the proposed new Impact Fee ordinance are that under the new language, impact f= ees could also be created for non-residential development. Additionally, the proposed change would allow the Planning Board to waive provisions of a specific impact fee when, in its judgment, an equivalent cash contribution = to the Town for specific off-site municipal or school projects would better address the impacts caused by the development. Under the proposed Impact Fee Ordinance, the Planning Board would also be able to accept an equivalent contribution of land or actual construction of municipal or school faciliti= es to satisfy waived impact fees, depending on which option best serves the Town’s interests. Each Impact Fee waiver would be considered individu= ally by the Planning Board and any contributions of real property in lieu of imp= act fees would require approval by the Board of Selectmen. As in the existing ordinance, Impact Fees cannot be imposed for additions to existing single-family residences.
