</span>Attorney Mason provided the Board with a description of the parcel a=
nd
how the subdivision was proposed.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Currently <st1:Street w:st=3D"on"><st1:address w:st=3D"on">Bearhill =
Road</st1:address></st1:Street>
ends in a temporary cul-de-sac and the applicant accesses their lot over the
50-foot right-of-way that was left at the end of the street.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>The applicants would like to have =
two
lots (one existing, one new) have access through the end of the cul-de-sac =
at <st1:Street
w:st=3D"on"><st1:address w:st=3D"on">Bearhill Road</st1:address></st1:Stree=
t> and
create two lots with access from <st1:Street w:st=3D"on"><st1:address w:st=
=3D"on">Mammoth
  Road</st1:address></st1:Street>.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>The applicant is seeking relief for frontage.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Mason told the Board that=
 the
applicant&#8217;s had spoken with their immediate neighbors on <st1:Street
w:st=3D"on"><st1:address w:st=3D"on">Bearhill Road</st1:address></st1:Stree=
t> and
had letters of consent from them.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>He said his client contacted the owner of Lot 3-130- had been contac=

and was not opposed to the proposal although they had nothing in writing.<s=

area of relatively steep terrain does not represent a reasonable planning

requested variance is not contrary to the purpose of the Ordinance as state=

answered no.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey fe=
lt the
variance request was premature because if approved it would carve two lots =
out
and make a temporary cul-de-sac permanent.<span style=3D'mso-spacerun:yes'>=
&nbsp;
</span>He said there were provisions for joint meetings with the Planning
Board.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara told the Boa=
rd when <st1:Street
w:st=3D"on"><st1:address w:st=3D"on">Bearhill Road</st1:address></st1:Stree=
t> was
put in a 50-foot right-of-way was left to extend the road farther in.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said if the relief was granted,=
 the
intent of the Planning Board would be destroyed in order to subdivide the
parcel.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He also commented tha=
t the
plan called for adding two driveways onto <st1:Street w:st=3D"on"><st1:addr=
ess
 w:st=3D"on">Mammoth Road</st1:address></st1:Street>, as opposed to extendi=
ng the
road through Bearhill.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey questioned =
how the
Board would grant a variance for two lots that didn&#8217;t exist.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Attorney Mason said they couldn&#8=
217;t
go to the Planning Board without the variance.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said they were showing the Boar=
d the
plan that would be brought to Planning.<span style=3D'mso-spacerun:yes'>&nb=
sp;
</span>Mr. McNamara commented that they could bring the plan to the Planning
Board as a conceptual plan because he felt there would be some strong
opinions.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He also commented t=
hat
the lot shapes were crazy.<span style=3D'mso-spacerun:yes'>&nbsp; </span></=

Attorney Mason said about not being able to bring the plan to the Planning

d to
have a joint meeting.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

had the
ability to conduct joint meetings with the Planning Board and the Conservat=

didn&#8217;t have a problem with having a joint meeting with the Planning

e-sac
and said additional facts would need to be researched regarding the rights =
to

was curious how the items on the lots were situated, such as the 4K areas.<=

style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi explained what the 4K ar=
eas
were and the requirements of the state law to be able to show a reserve are=
a.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Nickerson understood that ther=
e were
supposed to be two buildings, but saw on the plans that three buildings were
represented.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Zohdi stated=
 that
they were proposing four lots.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Attorney Mason said there would be three additional houses on the
parcel; one from <st1:Street w:st=3D"on"><st1:address w:st=3D"on">Bearhill =
Road</st1:address></st1:Street>
and two from <st1:Street w:st=3D"on"><st1:address w:st=3D"on">Mammoth Road<=
/st1:address></st1:Street>.<span

(owned lot 3-134-1) stated that he had been in front of the Board in 2006 f=
or a
different proposal for the same lot that never went anywhere.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>His concern with the development w=
as the
surveyed lot line, specifically with the abutting lot 3-133-3.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He explained that the surveyed line
running between the properties was off and ran approximately 100ft. onto his
property.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Mr. McNamara as=
ked if
Mr. Jeanson had the property surveyed.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>Mr. Jeanson said the land was surveyed <st1:date Month=3D"8" Day=3D"=

was an original field stone wall that had pins inserted when Mr. Jeanson had

that a
red flag was hung in a tree approximately 100ft. onto his property and assu=
med
that it was the surveyed line done for the proposed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey said the surveying w=
as
beyond the scope of the Board, but was sure that Herbert Assoc. would check
their surveying because no one would want a cloud on their title.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Jeanson reiterated that he had=
 no
problem with the proposal, but for his own satisfaction he wanted to know t=
hat
