appointed to vote regarding the case because they were present for the site

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Kearney provided a br=
ief
summary of what occurred during the site walk.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Two members of the Conservation
Commission were also present; however the Commission has not provided comme=
nt
regarding the case.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Shane Gendron of Herb=
ert
Associates, representing the applicants, came forward to discuss the propos=
ed
variance.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He said they had be=
en
asked to address the pool situation with the 410SF Wetland Conservation Imp=
act (&#8216;WCD&#8217;);
they added it to the application so it could be addressed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said two things that came up du=
ring
the site walk was slowing/redirecting water to be able to put it back into =
the
ground and minimize the effect of the building.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He proposed tying all the roof dra=
ins
into a mini dry well and located such on the plan.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>They had also been asked to mark t=
he
WCD; a note was added to the plan to install WCD signs every 50ft.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara asked if the=
re had
been any discussion during the site walk regarding mitigation of the swimmi=
ng
pool encroachment (other than the downspout).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey answered no.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Paliy said she found it intere=
sting
that the house was built up, and the pool area was raised up (approximately
5ft.-6ft.) above the WCD.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey said he had
struggled under the variance criteria (#5) to determine what distinguished =
the
property from every other property on that side of the road and the original
conditions imposed by Planning.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>Mr.
Gendron believed the hardship that was inherent to the property was the
placement of the existing house.<span style=3D'mso-spacerun:yes'>&nbsp; </s=
pan>He
said the addition was currently slated to be a one story addition.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>They felt coming off the existing
building 20ft. would be a minimum width for the addition to make sense for =
the
applicant&#8217;s family.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr.
Gendron reiterated that the house placement was the inherent hardship; no o=
ne
would have chosen that placement if they knew they would never be allowed to
add on to the home.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Ms. Paliy commented that =
there
didn&#8217;t seem to be another location to have placed the home.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>She wanted to know if it would be
possible to add onto the second floor.<span style=3D'mso-spacerun:yes'>&nbs=
p;
</span>She also asked about the water situation and if the house was being
flooded.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Ms. Paliy questioned=
 if
there was something more than the wetlands making the parcel unique.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron said the Town had heig=
ht
regulations and they wouldn&#8217;t be able to raise the height any more th=
an
it was.<span style=3D'mso-spacerun:yes'>&nbsp; </span>The existing home had
vaulted ceilings with sky lights; the entire roof would need to be removed =
in
order to construct using the proper trusses.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron provided a brief expla=
nation
of the lot&#8217;s limitations.<span style=3D'mso-spacerun:yes'>&nbsp; </sp=
an>He
showed where the house could have been placed on the lot to provide plenty =
of
room for an addition; however the house was placed at a ninety degree angle=
 at
the WCD.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He showed the areas =
on the
lot that remained in its natural state and were not proposed to be
altered.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey asked if it=
 was
being suggested that informally the owners had created a mitigation area.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron stated they wouldn&#82=
17;t
have a problem adding the area to the WCD making it a mitigation/conservati=
on
area with no future development.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Peter Zohdi of Herbert Associates came forward to show the area
being discussed.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He suggested=
 moving
the no-cut area from 50ft. to 100ft. away from the wetland.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. McNamara said he would be more
comfortable if there was that type of mitigation.</p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. McNamara asked for th=
e size
of the addition.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron =
said
it was roughly 20ft.x53ft.<span style=3D'mso-spacerun:yes'>&nbsp; </span>Mr.
McNamara questioned if it could be compacted to minimize the impact. Mr.
Gendron explained that the WCD impacts were occurring due to the width, not=
 the
length of the addition.<span style=3D'mso-spacerun:yes'>&nbsp; </span>He sa=
id the
20ft. width was being requested to make the space livable for the owners.<s=
pan
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. LaFrance concurred that reduci=
ng the
length wouldn&#8217;t make a difference in regard to the impact.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Hennessey agreed.<span
style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'><o:p>&nbsp;</o:p></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Ouellette asked if th=
ere were
stairs or decks proposed to come off the addition because it would create
further impacts to the WCD.<span style=3D'mso-spacerun:yes'>&nbsp; </span>M=
r.
McNamara pointed out the area would still require maintenance.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>Mr. Gendron said the owners were n=
ot
requesting anything more than the 20ft. shown.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>He said there were no decks etc. b=
eing
proposed; the front would be a full walk-out (matched grade).<span
style=3D'mso-spacerun:yes'>&nbsp;&nbsp; </span>There may possibly be steps =
off
the back portion of the addition.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>Mr. Hennessey noted that the pool was existing so there wouldn&#8217=
;t
be additional impacts in the back (of the addition).<span
style=3D'mso-spacerun:yes'>&nbsp; </span>There was further discussion regar=
ding
the proposed building and its access.<span style=3D'mso-spacerun:yes'>&nbsp;
</span><span style=3D'mso-spacerun:yes'>&nbsp;</span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Gowan commented that =
if the
Board decided to grant the requested variance, that they consider the area
shown with the silt fence (5ft. off foundation) to be a reasonable area for
disturbance/encroachment for maintenance.<span style=3D'mso-spacerun:yes'>&=
nbsp;
</span>Mr. Kearney pointed out that the applicant had already requested 5ft.
around the building for grading.<span style=3D'mso-spacerun:yes'>&nbsp;
</span>The plan was marked temporary, when it should have been marked
permanent.<span style=3D'mso-spacerun:yes'>&nbsp; </span></p>

<p class=3DMsoNormal style=3D'text-align:justify'>Mr. Hennessey said the Bo=
ard
would accept a friendly amendment to the application.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>On the plan where it&#8217;s marke=
d as a
temporary impact to WCD will in fact be the impact to the WCD.<span
style=3D'mso-spacerun:yes'>&nbsp; </span>There was a consensus of the Board=
 to
allow the friendly amendment to the plan.<span style=3D'mso-spacerun:yes'>&=

</span>Mr. Gowan requested that the recordable plan show the correct

id a
new septic design had been done and recently approved by the state and the
