PLANNING BOARD
TOWN OF PELHAM, NEW HAMPSHIRE
Notice
is hereby given in accordance with RSA 675:3-7, the Pelham Planning Board
will hold its first of two public hearings to discuss zoning amendments
proposed for the 2009 Town Meeting. This first public hearing shall take
place on January 5, 2009 at 7:00 pm at the Town Hall, 6
Village Green, Pelham, New Hampshire. The proposed amendments are
described as follows:
Item #1: To amend Article XII, Special
Exceptions, Section 307-76 II, 8 and 307-76 III, 2 to clarify the
limitations on display of vehicles for sale on residential properties to two
within any twelve (12) month period and to clarify that the limitation on
home occupations regarding the ratio of residential use to business use
shall not exceed 49% of the square footage including accessory structures on
the property.
Item #2: To add a new article (Article
XVI) to Pelham’s Zoning Ordinance to accommodate small wind energy systems
in appropriate locations, while protecting the public’s health, safety and
welfare. The proposed ordinance provides a permitting process for small
wind energy systems to ensure compliance with the provisions of the
requirements and standards established within the article including
limitations on tower height, system setbacks from abutting property, roads
and utility lines as well as control of shadow flicker effects, sound and
visual impacts. Article XVI is based on the model ordinance developed by
the NH Office of Energy and Planning (OEP) in accordance with RSA 674:62-66
and RSA 672:1-III-a.
Item #3: Amend Article VIII, Floodplain
Development Ordinance to add a new sub-article VIII-I XI, Illicit Discharge
Ordinance to provide for the
regulation of non-storm water discharges to
the storm drainage system to the maximum extent practicable as required by
federal and state law. This ordinance establishes methods for controlling
the introduction of pollutants into the Municipal Separate Storm Sewer
System (MS4) in order to comply with requirements of the National
Pollutant Discharge Elimination System (NPDES) permit process. The
objectives of this ordinance are to regulate the contribution of pollutants
to the MS4 by storm water discharges by any user, to prohibit illicit
connections and discharges to the MS4 and to establish legal authority to
carry out all inspection, surveillance, monitoring, and enforcement
procedures necessary to ensure compliance with this ordinance.
Item #4: Amend Article XV, Conservation
Subdivisions to provide for workforce housing by allowing affordable
units within Conservation Subdivisions and considering those units among the
features qualifying for density offsets. These amendments to the
Conservation Subdivision ordinance in conjunction with changes to Pelham’s
subdivision regulations will make Pelham compliant with new Workforce
Housing Law, RSA 674:21, IV(a) and prevent the “builder’s remedy” from being
awarded by the Court’s without local land use review and oversight.
